Since the Appeals Chamber, however, failed to issue an explanation in writing of its decision to allow the prosecutor to expand the indictment, the defense of Milan Kovacevic requested a postponement of the second initial appearance in order to be given an opportunity to "exercise its right to review the opinion of the Appeals Chamber before making a further plea."

The defense's request was accepted, and the Trial Chamber II issued an order rescheduling the further appearance of the accused to plead to the new charges for 6 July 1998, following the opening of the trial.
